L-1A VISA:
INTRA-COMPANY TRANSFERS: EXECUTIVES AND SPECIALIZED KNOWLEDGE WORKERS
This is by far the most effective visa to set up an
affiliated company in the United States. In order to be entitled to
this type of visa an executive (L-1A) and/or a specialized knowledge
worker (L-1B) must be transfered from a Canadian company to an American
affiliate. The individual in question must be a Canadian citizen, a
manager/executive and/or a specialized knowledge worker, and must have
been employed with the affiliated company in Canada for twelve
non-consecutive months in the last three years.
This work permit, also referred to as « expansion visa », allows its holder to quickly apply for permanent residence (Green Card). This type visa can be extended to a maximum of seven (7) years for L-1A holders and five (5) years for L-1B holders.
Important fact : Spouses and children of L-1A and L-1B holders are entitled to reside and work in the U.S. Green card - Employment base application.
